VIVID SEATS TERMS AND CONDITIONS FOR GIFT CARDS, EGIFT CARDS AND PROMOTIONAL
CODES

	<li class="vdp-type-list-item">General. By purchasing, accepting, using or redeeming Gift Cards, eGift Cards and Promotional Codes (the “Cards”), you agree to be bound by these Card Terms and Conditions (the “Terms”). These Terms, along with the <a class="vdp-type-link" href="/terms#p1">Global Terms of Use</a>, the <a class="vdp-type-link" href="/sellerterms#p1">Global Seller Terms</a> and <a class="vdp-type-link" href="/privacy">Privacy Policy</a>, apply to your use of Cards. Cards shall be subject to the same terms as "tickets" under those policies. IMPORTANT: Please note that the Global Terms of Use contain an arbitration agreement and class action waiver. You and Vivid Seats LLC (“Vivid Seats”) mutually agree that any dispute, claim, or controversy will be resolved through binding, individual arbitration—and not in court or through a class action lawsuit or class-wide arbitration.</li>
	<li class="vdp-type-list-item">Issuer; Legal Obligor. The Cards are issued by Vivid Seats. As the issuer, Vivid Seats is responsible for the operation and maintenance of the Cards and the Card programs and is the sole legal obligor to you; provided, however, that Vivid Seats may assign its obligations with respect to the Cards at any time, in which case such assignee shall become the issuer and sole legal obligor.</li>
	<li class="vdp-type-list-item">Redemption. The Cards must be redeemed through the VividSeats.com website at <a class="vdp-type-link" href="/">https://www.vividseats.com</a> or through our call center at <a href="tel:8668488499">866.848.8499</a>. The Cards cannot be used to purchase additional Cards. They are not redeemable for cash and do not qualify for cash refunds unless required by law. If additional payment is required following use of a Card, the purchaser must pay for the balance of the transaction through an alternate form of payment, such as a credit card.</li>
	<li class="vdp-type-list-item">Not Usable to Purchase Tickets for Resale. Cards are intended to encourage fans to attend live events. Cards are only available for ticket purchases where the next use of that ticket is for an individual to attend an event and not for resale or for any other purpose. If it is discovered that an individual, group or company has been utilizing the Cards for the purchase of tickets for the purposes of resale, this shall be considered a violation of these Terms and the Global Seller Terms and all penalties detailed in the Global <a class="vdp-type-link" href="/sellerterms" target="_blank">Seller Terms</a> may apply at Vivid Seats’ sole discretion.</li>
	<li class="vdp-type-list-item">Additional Terms for Promotional Codes. Unless otherwise expressly provided for specific Promotional Codes, Promotional Codes are single-use only and the amount of the transaction towards which a Promotional Code is redeemed must exceed the value of the Promotional Code. Additionally, Promotional Codes may have a minimum purchase requirement, a maximum discount cap or other purchase or redemption restriction. Any such restrictions will be identified for the specific Promotional Codes.</li>
	<li class="vdp-type-list-item">Lost, Stolen or Damaged Cards; Cards Used Without Authorization. Lost, stolen, damaged, or destroyed Cards will not be refunded or replaced by Vivid Seats. We are also not responsible if a Card is used without your permission and shall have no obligation to replenish the value of any unauthorized use of Cards.</li>
	<li class="vdp-type-list-item">Expiration; Fees. Gift Cards and eGift Cards do not expire. Promotional Codes may expire as indicated for the specific Promotional Codes. No fees for inactivity, maintenance or service fees apply to Cards.</li>
	<li class="vdp-type-list-item">Fraud. Vivid Seats reserves the right to close customer accounts and seek alternate forms of payment if a fraudulently obtained Card is redeemed and/or used to make purchases on vividseats.com or through the call center </li>
	<li class="vdp-type-list-item">Changes to Terms. Vivid Seats reserves the right to change these Terms at its sole discretion. Vivid Seats will post the updated Terms on this website.</li>
	<li class="vdp-type-list-item">Card Balance. To check your Card balance, please contact us at <a href="tel:8668488499">866.848.8499</a>.</li>
	<li class="vdp-type-list-item">WARRANTIES; LIMITATION OF LIABILITY. VIVID SEATS MAKES NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO CARDS INCLUDING, WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OR MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN THE EVENT THAT A CARD IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, SHALL BE THE REPLACEMENT OF SUCH CARD. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OR CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR AL L OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU.</li>
	<li class="vdp-type-list-item">Governing Law. The laws of the State of Illinois, without regard to principles of conflict of laws, shall govern these Terms, use of Cards and is the substantive law applicable to any claim or dispute that may arise out of or relate to these Terms or your use of Cards.</li>
<li class="vdp-type-list-item">Severance. If any part of these Terms is deemed invalid or inapplicable, such provision shall be modified or restricted to the extent and in the manner necessary to render it valid, legal, and enforceable. If such provision cannot be so modified or restricted, it shall be excised from these Terms without affecting the validity, legality, or enforceability of the remainder of these Terms, which shall be fully enforced.</li>
